"By registering a .uk domain name, you enter into a contract of registration with Nominet UK
on the terms and conditions here. This is a separate contract
to any arrangement you may have with any third party for the provision of internet services. Please read before proceeding with your order."
The signed
Application Form, Order Confirmation, website order
submission or order from our secure online
accounts system constitute acceptance of these terms and
conditions.
Acceptance of payment terms is a
condition of sale.
We dislike small print and have no
hidden charges. Nor to we penalise clients who no longer
wish to trade with us. We would rather provide an
excellent package both technically and in the service we
offer.
It is coming increasingly common
for low initial costs to be heavily marketed and only
once a contract with penalties is agreed do the full
costs become apparent or basic features that could
reasonably be expected are held back with additional
fees being payable.
Terms of payment are 7 days net of
the issue date of the invoice. Any invoice queries
should be raised within 48 hours of invoice issue.
Automated reminders will be sent
every 3 days on overdue accounts. Those accounts in
default for 9 days will be immediately terminated
without further notice. This new system will benefit the
vast majority of clients as the burden of processing
reminders is a cost we are not prepared to pass on to
client who keep their accounts in good order.
All goods remain the property of
Optima Solutions Ltd until payment in full is received.
Any typographical, clerical or
other error or omission in any sales literature,
quotation, price list, acceptance of offer or other
documents of information issued by an agent of or for
Optima Solutions Ltd shall be subject to correction
without any liability on the part of Optima Solutions.
Services for
Reseller
We have specialised
in offering outstanding support to resellers. Our
philosophy is to pass on the savings in marketing costs
and our benefits in buying in bulk to those reseller who
have brought to us multiple accounts or domain
registrations. In addition the reduced support costs are
passed back to resellers in their discounts.
In return it is expected
that resellers will be responsible for the billing and
front line support of their clients.
Any savings or discounts
are clearly stated and will not be withheld on the basis
or trading value. Particularly the offering of a high
discounted and the with holding of that discount is to
us morally unacceptable even though this is a standard
business practice used by some hosting companies who
advertise their outstanding support to resellers.
Many companies are not
able to offer fast knowledgeable support because they
have large numbers of clients to support or too few
experienced support staff.
If we have our commercial
strategy or support wrong is it fair to penalise the
customer we don't think so.
Internet Services and Products
Failure to settle
the invoice by the due date will result in the
withdrawal of the product or service. For example, a
domain name will be de-registered without notice,
website hosting will be suspended, new webpage contents
will not be posted to the Internet, hosted sites will be
temporarily suspended.
All rental services will be
invoiced in advance. The minimum contract period is 3
months. Cancellation of services is required in writing
with one month’s notice given.
The Customer indemnifies Optima
Solutions Ltd against all claims, damages, penalties,
costs or expenses arising out of or attributed to any
third party allegation in relation to a name to be
registered infringing any rights owned by a third party
and infringement of any copyright, patent or design of a
third party and that any part of a website content or of
an email message does not contain material which may be
deemed to be offensive or defamatory which would
constitute an actionable wrong and in so doing render
Optima Solutions Ltd liable to civil or criminal
liability.
Email redirection will only be
actioned upon receipts of a signed confirmation on
company headed paper or via the email address itself.
Optima Solutions will have no
liability for any failure in any service where the
failure is due to external forces and does not result
from negligence or deliberate fault of Optima Solutions
Ltd.
Hardware
and Software
A minimum of 50%
of the total invoice price will be required at the time
of order placement.
The balance is to be paid within
the terms of the invoice after delivery/ installation
has taken place.
